About VintWire

VintWire is an independent UK business operated by a sole trader. It provides wine-market information and tools designed to help users discover, monitor and compare activity across the UK wine market.

References in these terms to VintWire, we, us or our refer to the operator of the VintWire service.

Using VintWire

These Terms of Use apply when you access or use the VintWire website and services.

Please read them before using an account or any paid VintWire service. If you do not agree to these terms, you should not create an account or purchase a VintWire subscription.

Nothing in these terms affects any rights that you have under applicable consumer law and that cannot lawfully be excluded or restricted.

Age and eligibility

VintWire is a wine-market service intended for adults aged 18 and over.

You must be at least 18 years old to create or use a VintWire account.

VintWire does not itself sell or supply alcohol. Purchases of wine are made from independent merchants, whose own terms, age-verification procedures and licensing obligations apply to the transaction.

Accounts

Some VintWire information and functionality is available only to registered users. Additional features may be restricted to particular subscription tiers.

When creating an account, you must provide information that is accurate and must keep your account credentials secure. You are responsible for activity carried out through your account where it results from your failure to take reasonable care of those credentials.

Please contact VintWire promptly if you believe that your account has been accessed without permission.

Accounts are personal unless VintWire expressly agrees otherwise. You must not sell, transfer or make an account available for unauthorised shared use.

Market information

VintWire collects, organises and presents information relating to wines, merchants, prices, availability, offers and market activity.

Merchant information can change quickly. Prices, availability, case formats, taxes, duty status, delivery terms, vintages and other offer details may change after VintWire observes or publishes them.

VintWire takes reasonable steps to maintain useful and accurate market information, but the service should not be treated as a guarantee that a merchant offer remains available or that every displayed detail is current at the moment you view it.

Historical prices, price changes, market comparisons, discounts and other market information are provided for information purposes. They do not constitute financial, investment, tax or legal advice, and VintWire does not guarantee that a wine will increase or decrease in value.

Independent merchants and purchases

The wine merchants shown on VintWire are independent third parties. Unless a page expressly states otherwise, they are not agents of VintWire and VintWire is not acting as their retailer.

When you follow a VintWire link to a merchant and decide to purchase a product, the purchase is made between you and that merchant. The merchant is responsible for its checkout, payment processing, stock, fulfilment, delivery, returns, refunds, product descriptions and age verification.

The merchant's own terms and policies apply to that transaction. You should review them before purchasing.

A merchant's appearance on VintWire does not by itself amount to an endorsement of that merchant or a guarantee of its products or services.

Affiliate links and commercial relationships

Some links from VintWire to merchants may be affiliate or tracked links. This means VintWire may receive a commission or other benefit if you follow a link and subsequently make a qualifying purchase.

Affiliate arrangements do not change the price charged to you by a merchant unless the merchant expressly states otherwise.

VintWire may also enter into advertising, partnership or other commercial arrangements. Where a particular piece of content or placement is sponsored or paid for in a way that requires disclosure, VintWire will identify that relationship appropriately.

Alerts and communications

VintWire may provide features such as watchlists, saved searches, price or availability alerts, notifications and email updates.

Market alerts depend on the information available to VintWire and on technical delivery systems. An alert may be delayed, may not be delivered, or the underlying merchant information may have changed by the time you receive it.

You should not rely on an alert as the sole means of monitoring a time-sensitive purchase or market event.

Transactional or service communications are separate from optional marketing communications. Where marketing consent is required, VintWire will handle that choice separately.

Paid services and subscriptions

VintWire may offer paid subscription tiers or other paid services. Before you purchase a paid service, VintWire will present the applicable price, billing period, included features and any material subscription or cancellation information.

The terms presented when you purchase a paid service, together with these Terms of Use, will govern that purchase. If there is a conflict about a specific paid feature, the more specific information presented for that purchase will apply to that feature.

VintWire will not use these terms to remove or reduce statutory rights that apply to consumers.

Acceptable use

You may use VintWire for lawful personal or business purposes consistent with the normal operation of the service.

You must not:

• use VintWire for unlawful, fraudulent or abusive activity;
• attempt to gain unauthorised access to accounts, systems, databases or restricted areas;
• interfere with the security, availability or normal operation of the service;
• introduce malicious code or deliberately harmful material;
• impersonate another person or misrepresent your authority to act for another person;
• use automated systems to scrape, harvest, copy or extract VintWire data at a scale or in a manner that places an unreasonable burden on the service or circumvents access controls; or
• reproduce or commercially redistribute a substantial part of VintWire's database, compiled market information or proprietary content without permission where applicable rights prevent that use.

This section does not restrict any use that applicable law expressly permits and that cannot lawfully be restricted by contract.

Intellectual property

VintWire's branding, original editorial material, website design, software, selection and arrangement of information, and other original content may be protected by copyright, database rights, trade mark rights or other intellectual property rights.

Merchant names, logos, product images, wine names and other third-party material remain the property of their respective owners where applicable. Their appearance on VintWire does not transfer those rights to VintWire or to users.

You may use the service normally through the website and may make reasonable personal references to information you view. Nothing in these terms grants a right to reproduce, republish or commercially exploit protected VintWire content or databases beyond what applicable law permits.

Availability and changes to VintWire

VintWire may maintain, improve, replace or discontinue website features as the service develops.

We may temporarily restrict access where reasonably necessary for maintenance, security, technical problems or circumstances outside our reasonable control.

Where a material change affects a paid service, VintWire will take account of applicable consumer rights and any specific subscription terms before making the change.

Responsibility and liability

Nothing in these terms excludes or limits liability where doing so would be unlawful. In particular, nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any consumer right or other liability that cannot lawfully be excluded or restricted.

VintWire is responsible for providing its own service in accordance with applicable law and any binding commitments it makes to you.

VintWire is not responsible for performing a contract that you enter into directly with an independent merchant. Issues concerning a merchant's product, payment, delivery, return, refund or other performance should normally be addressed with that merchant, without affecting any separate legal rights you may have.

Because market information can change between collection and display, you should verify time-sensitive price, stock and product information with the merchant before acting on it.

Ending or restricting access

You may stop using VintWire at any time. Account closure and subscription cancellation arrangements will be made available where applicable.

VintWire may restrict or suspend access where reasonably necessary to protect the service or other users, respond to suspected unlawful activity, address a serious or repeated breach of these terms, or comply with a legal obligation.

Where appropriate in the circumstances, VintWire will provide an explanation or reasonable opportunity to address the issue. Any action affecting a paid consumer service remains subject to applicable consumer rights.

Changes to these terms

VintWire may update these terms as the service, law or business model develops.

The current version will be published on this page with its latest update date. If a change materially affects an existing paid service or a user's contractual rights, VintWire will provide any notice or choice required by applicable law and the relevant subscription terms.

Changes will not be used retrospectively to remove rights that have already arisen under applicable law.

Governing law and disputes

These terms are governed by the laws of England and Wales.

If you are a consumer, this does not deprive you of any mandatory protections available to you under the law of the part of the United Kingdom or other jurisdiction in which you live where those protections apply.

If a dispute arises, please contact VintWire first so that we can try to resolve the matter directly. Nothing in these terms prevents either party from using a court or another dispute-resolution route available to them under applicable law.
